California District Court Rules Against Lifelock

Last month, the District Court in California granted Experian’s motion for partial summary judgment on its claim for unfair competition against Lifelock. However, Lifelock has filed a motion to reconsider in California’s U.S. District Court in the case of Experian v. LifeLock

In this case, Experian seeks to block Lifelock from placing fraud alerts for consumers.

Update on Class Action Complaint Against Lifelock

Clicking on the above title will take you to the pdf of the actual class action complaint filed against Lifelock. You can read all items of the complaint and why it was filed in March 2008.

You will notice that Grant Woods, PC is also listed as an attorney for the plaintiff. He is the former Arizona Attorney General.

I spoke with Attorney Leonard Aragon at the law firm of Hagens Berman Sobol Shapiro LLP. He told me that 15 cases, against Lifelock, which have been filed nationwide have all been brought together in Arizona at the United States District Court under Honorable Judge Mary H. Murguia

As soon as more information is available, I will let everyone know. The case could take 1-3 years.

LifeLock Sued for Corporate Identity Theft

LifeLock is in the news again.

The identity theft protection firm whose CEO lists his Social Security number in ads for the company is being sued by Namesafe, a competitor in the identity theft protection market, for allegedly stealing the company's corporate identity and deceptive trade practices.

According to papers filed in Tennessee, Namesafe claims that LifeLock stole its trademark and deceptively diverted traffic meant for Namesafe's web site to LifeLock's own web site.

...The company says that when users did a search on the word "Namesafe," sponsored ads appeared at the top of search result pages, which included a link for "Namesafe" and "Namesafe.com." But when users clicked the link, it took them to LifeLock's web site instead. The name LifeLock appeared in the ads next to or beneath "Namesafe" and "Namesafe.com," but Namesafe says the ads were clearly designed to fool Namesafe customers...

...This is not the first lawsuit against LifeLock. The company has been the target of class-action lawsuits from customers questioning its protection claims as well as a suit from credit reporting agency Experian for acting on consumers' behalf to place alerts on their credit accounts... Identity Truth, Inc. Faces Legal Test

Identity-theft services face legal test
Suit targets claims by rival of local start-up

IdentityTruth Inc. of Waltham says it will reimburse customers up to $2 million if they're victims of identity theft. But a Phoenix lawyer says the identity-protection company's promise isn't worth nearly that much.

IdentityTruth charges $10 a month or $100 a year to insure people against unauthorized use of their personal information. The privately held company is funded with about $20 million in venture capital from investors that include Argonaut Ventures and Stata Venture Partners. It's one of a host of companies that say they protect consumers from identity theft crimes, which cost Americans $49 billion last year, according to Javelin Strategy & Research Corp.

IdentityTruth posts fraud alerts with credit reporting agencies on behalf of its customers. These alerts warn banks and other businesses not to open new accounts unless they confirm the identity of the customer. In addition, IdentityTruth scours the Internet and a host of private and government-run databases, looking for evidence that somebody out there is pretending to be you. The company doesn't actually pre vent identity theft; it's designed to warn you immediately when a theft occurs.

The IdentityTruth website states, "if you are a member of our service and are a victim of identity theft resulting in the loss of your money, we will reimburse you up to $2 million."

But Rob Carey of the law firm Hagens Berman Sobol Shapiro in Phoenix said the fine print of the IdentityTruth guarantee belies this assertion. Carey recently filed a lawsuit in the US District Court of Arizona against a rival service, LifeLock Inc. of Tempe. The suit, which seeks class-action status, claims LifeLock's $1 million guarantee is fraudulent because it contains loopholes that make it far less generous. Carey said the same loopholes are present in the IdentityTruth guarantee......

....In addition, the IdentityTruth guarantee excludes coverage of "consequential damages." According to Carey, that would include any debts incurred by an identity thief....

....Asked why the guarantee doesn't cover debts incurred by identity thieves, he replied, "The reality is that most of the money that would be lost here would be covered by the person's bank." (Full text at www.boston.com)

Lifelock sued Again!

It seems that Lifelock is being sued on a consistent basis with three recent filings, which an attorney is trying to get combined into a class action suit. Anyway, the article confirms what I have been saying all along. Get your ID Theft protection from experienced companies (a link is presented at the end of this post).

For a time, the ads were everywhere on TV and radio, the ones with the head of a security company brazenly challenging would-be thieves to try to steal his identity.

Richard Todd Davis, CEO of LifeLock Inc., was so confident in his company's ability to protect his identity that he publicly revealed his Social Security number: 457-55-5462.

But according to a new class-action lawsuit filed last week in Jackson County, LifeLock's identity theft protection services were so inept that Davis' personal information was stolen repeatedly.

"While LifeLock has only publicly acknowledged that Davis' identity was compromised on one occasion, there are more than 20 driver's licenses that have been fraudulently obtained [using his personal information]," the suit states.

"Furthermore, a simple background check performed using Davis' Social Security number reveals that his entire personal profile has been compromised to the extent that the birth date associated with his Social Security number is Nov. 2, 1940, which would [inaccurately] make Davis 67 years old.".....

..LifeLock... made false and misleading claims in its multimillion-dollar ad campaign about the level of protection it provides....

...LifeLock doesn't protect against many forms of identity theft, according to the lawsuit.....
... LifeLock knows, yet fails to disclose, that the services it provides do not offer the breadth of protection that it promotes ....

.."In actuality, once you get beyond the numerous legal limitations and disclaimers, the policy really only guarantees that LifeLock will investigate how to fix its failure," Grubb said in a news release. .....In addition, the company fails to reveal that it obtains its credit reports by requesting on its clients' behalf their free annual credit report. That means consumers can't ask for their own free report for at least 12 months, according to the suit.....
Remember, only go to www.annualcreditreport.com for your free reports and obtain a report from one bureau and your next free report from a second bureau approximately 4 months later and the third bureau again in 4 months. This way you are checking your credit throughout the year. Finally....

South Carolina Identity Theft Bill provides more consumer protection

Columbia, SC…..South Carolina consumers can do more to protect their identity now that the General Assembly passed and Governor Mark Sanford signed the “Financial Identity Fraud and Identity Theft Protection Act” on April 2, 2008. The Act provides much needed protection for consumers and is one of the most consumer-friendly and comprehensive bills of its kind in the nation.

A primary provision in the bill allows consumers to freeze and thaw their credit report at no charge. Any consumer may place a freeze on their report, including those wanting to take proactive measures to protect themselves against identity thieves or not wanting to receive more credit than they can financially handle. Businesses, however, have no need to worry about consumers not being able to make purchases as they choose. Thawing your credit only takes one phone call and 15 minutes. South Carolina is one of only two states in the country that provides this service to consumers free of charge. The Act also provides requirements in the area of credit report disputes that are similar to those in the Federal Fair Credit Reporting Act. Under the Financial Identity Fraud and Identity Theft Protection Act, credit reporting agencies must follow certain procedures when a consumer notifies it of an inaccurate or untimely item on their credit report. The consumer is also given the right to sue a credit reporting agency if it does not comply with the Act. This portion of the act will be effective December 31, 2008.

In addition to giving consumers more control with their credit, the bill also addresses identity theft concerns. According to the Act, organizations and businesses who maintain consumers’ personal information must now alert consumers when their personal information may have been compromised. Notice of the security breach must also be given to the Department if 1000 more South Carolina consumers were affected. The Department has been given the responsibility of ensuring consumer are being informed when their identity has been compromised internally or externally. This portion of the bill will be effective July 1, 2009.

The bill also requires all organizations and businesses collecting personal information to have measures for the safe disposal of material “in a manner that makes it unreadable or undecipherable.” The Department has been tasked to ensure this requirement is satisfied. This portion of the bill will also be effective July 1, 2009.


Other provisions of the Act include making identity theft a crime, prohibiting dumpster diving, putting restrictions on the use of social security numbers, and limiting the information on credit card receipts.
